FMCSA Clearinghouse

To all DOT FMCSA CDL drivers and employers, it is mandatory that you sign up on the FMCSA Clearinghouse. If you are not registered, visit https://clearinghouse.fmcsa.dot.gov/ immediately to get started. Whiz Guys, Inc. is set up on the FMCSA Clearinghouse as a Consortium/Third Party Administrator (C/TPA). If your company is enrolled in our random drug and alcohol testing program, designate us as your C/TPA and allow us access to conduct queries, report violations, and record return to duty (RTD) tests for your company. If you are an owner operator or single driver company that is enrolled in our random drug and alcohol testing program, you MUST designate Whiz Guys, Inc. as your C/TPA.

What is the FMCSA Clearinghouse?

The Clearinghouse is a secure online database that gives employers, the Federal Motor Carrier Safety Administration (FMCSA), State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. The Clearinghouse contains records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information is also recorded in the Clearinghouse.

What is a Query?

A query is an electronic check in the Clearinghouse, conducted by an employer or their designated C/TPA, to determine if current or prospective employees are prohibited from performing safety-sensitive functions, such as operating a commercial motor vehicle (CMV), due to unresolved drug and alcohol program violations. There are two types of queries, limited queries (which satisfy the annual query requirement) and full queries (which include all pre-employment queries). All queries require driver consent. Limited queries check for the presence of information in the queried driver’s Clearinghouse record. Driver consent is obtained outside the Clearinghouse. You can download a sample consent form on the Clearinghouse website, personalize it to your company information, and have each of your drivers sign it before you conduct a query on them. https://clearinghouse.fmcsa.dot.gov/Query/Plan

Full queries will disclose to employers and C/TPAs detailed information about any resolved or unresolved violations in a driver’s Clearinghouse record. The driver’s specific electronic consent in the Clearinghouse is required. The driver will have to login to the Clearinghouse as a driver to give the consent.
If a limited query returns a result that information is in the Clearinghouse, a full query must be conducted to gather that information.
One time per year, it is required that the employer conduct a query on every driver in their company.
